Terms & Conditions

1. Engagement

If you book a mediation with me, I will send you a letter confirming details of the mediation, the parties and fees.

2. Mediation agreement

I will issue a mediation agreement to each person attending the mediation prior to the mediation. I use the Resolution Institute standard mediation agreement which you can view on my website. The agreement must be signed by all attendees prior to the commencement of the mediation.

3. Fees and acceptance of terms

  • The daily fee for an all-day mediation is $3,600, plus GST, for any part or all of one day regardless of the number of parties.
  • The fee for a half-day mediation is $1,800, plus GST, for any part of that half day.
  • The mediation fee includes 2 hours for considering all documents provided to me before the mediation. Any time spent considering documents beyond 2 hours is charged at $250, plus GST, per hour spent.
  • The mediation fee includes a pre-mediation conference.
  • The mediation fee does not include airfares.

4. Cancellation

Should you need to cancel the mediation, a cancellation fee of 50% of the mediation fee will apply if cancelled within 14 days of the mediation booking. No cancellation fee will be charged if the mediation booking is rescheduled to a later date.

5. Venue

The parties should agree and arrange a mutually convenient venue at the parties’ costs that is comfortable for all parties. There are several mediation spaces located in central business districts. In rural areas, suitable rooms may be available in the local library or community centers

6. Extra charges

If airfares are required for me to attend the mediation, I will notify the parties of the cost and seek consent at the time of confirming the booking. Any other additional charges such as meals and accommodation will be borne by me.

7. Tax invoice

I will invoice each party within 7 days after the mediation. The invoice will be split as requested by the parties in the mediation agreement.

8. Payment

  • Payment is via an Electronic Funds Transfer (EFT) into my bank account. The payment details are set out in my invoice or can be obtained by calling me.
  • Payment is to be made within 7 days of the invoice date.

9. Mediator’s role

As the mediator I will not provide any attendee at the mediation legal advice or determine the dispute. Each party, and their legal representative, should be aware to come to the mediation in good faith prepared to negotiate on the issues and with the authority to sign an agreement should one be reached.

10. Agreed bundle of documents

  • The parties should as best they can agree on the bundle of documents for my consideration.
  • It would be helpful if the bundle included the initiating documents, expert reports exchanged and any other evidentiary document relevant to the issues, the subject of the mediation.
  • The agreed bundle should be marked “Without prejudice and for the sole purpose of mediation only” and emailed to me at jt@jacquelinetownsend.com.au or a hard copy delivered to me at 223 Liverpool St, Darlinghurst NSW 2010.

11. Retention of documents

The documents I retain after the mediation include,

  • the mediation agreement
  • final settlement document
  • my invoice.

I do not retain my notes created during the mediation.
